Terms and Conditions (T&C)

1. Scope

These Terms and Conditions (“T&C”) apply to all orders placed through the website of Dropsneak between:

(hereinafter referred to as “Dropsneak”, “we”, “us”, or “our”)

and the customer (hereinafter referred to as “customer”, “you”, or “your”).

Any conflicting or deviating terms of the customer shall not apply unless expressly agreed to in writing by Dropsneak.


2. Subject of the Contract

Dropsneak offers sneakers and footwear for sale through its online store.

Sales are carried out within the framework of a drop-shipping business model. This means that Dropsneak does not permanently store the goods physically but forwards customer orders to partners, suppliers, or manufacturers.

The goods are then shipped directly to the customer by the respective supplier or fulfillment partner.

The purchase contract is concluded between the customer and Dropsneak. However, logistics, storage, and shipping are handled by third-party providers.


3. Conclusion of Contract

The presentation of products on our website does not constitute a legally binding offer but rather a non-binding invitation to place an order.

By clicking the “Buy Now” button, the customer submits a binding offer to purchase the goods contained in the shopping cart.

The automatic order confirmation sent by email does not constitute acceptance of the offer.

The purchase contract is only concluded when Dropsneak expressly accepts the order or ships the goods to the customer.


4. Prices and Payment Terms

All prices are stated in Euro (EUR) and include applicable statutory VAT unless otherwise stated.

The prices valid at the time of the order shall apply.

Payment can be made using the payment methods offered in the online shop (e.g. credit card, PayPal, Klarna, instant bank transfer).

Dropsneak reserves the right to exclude certain payment methods in individual cases.


5. Shipping and Delivery

Delivery is carried out by partners, suppliers, or fulfillment service providers directly to the delivery address specified by the customer.

The regular delivery time is approximately 8–16 business days within Europe, depending on the supplier’s location, shipping method, customs clearance, and destination address.

Due to high order volumes, occasional shipping delays may occur. These delays may be caused by third-party logistics providers, customs processing, transport issues, force majeure, or supplier shortages.

Customers will be informed by email in the event of significant delays.

Partial deliveries are permitted if reasonable for the customer.

Dropsneak is not obligated to deliver if we are not supplied correctly or on time despite having concluded a proper covering transaction. In such cases, payments already made will be refunded immediately.


6. Retention of Title

The goods remain the property of Dropsneak or the respective delivery partner until full payment has been received.


7. Right of Withdrawal & Returns

Consumers are entitled to a statutory right of withdrawal in accordance with applicable consumer protection laws.

As shipping is handled through external fulfillment partners, returns are only possible after prior contact with our support team.

Products may only be returned if they are unworn, unused, and in their original condition and packaging.

If a product arrives damaged, customers must contact us within 24 hours after delivery and provide clear photos of the damage.

Returns sent without prior notice cannot be processed.


8. Warranty and Liability

Statutory warranty rights apply.

As storage, shipping, and transportation are carried out by third-party providers, deviations in packaging, labeling, or external appearance may occur.

Dropsneak shall not be liable for damages or delays caused by shipping providers, suppliers, or other third parties.

Liability for slightly negligent breaches of duty is excluded unless essential contractual obligations or damages to life, body, or health are affected.


9. Product Information – International Market Products

The products offered by Dropsneak are manufactured in Asia and distributed through international production and supply chains. Some products may have been produced for markets outside Europe.

As a result, packaging, labels, serial markings, boxes, inserts, material quality, stitching, fit, sizing, or minor product-specific details may differ from versions intended for the European market.

Please note that shoes and clothing may run smaller than standard European sizing. We generally recommend ordering one size larger for the best fit.

All products are new and unworn and meet the common manufacturing and quality standards of their respective production region.

Differences related to international market versions, including variations in packaging, labeling, material feel, or sizing, do not constitute a defect under warranty law.

10. Disclaimer for Delivery Delays

As shipping is handled by external partners, extended delivery times may occur in individual cases.

Dropsneak accepts no liability for delays beyond our control, including but not limited to:

  • Customs clearance procedures
  • Transport or logistics issues
  • Natural events or force majeure
  • Strikes or governmental measures

11. Data Protection

Dropsneak processes personal data exclusively in accordance with applicable data protection laws, including the GDPR.

12. Final Provisions

The laws of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

If the customer is a merchant, legal entity under public law, or special fund under public law, the place of jurisdiction shall be the registered office of Dropsneak.

Should individual provisions of these T&C be wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.

13. Intermediary Role

Dropsneak acts solely as an intermediary and sales platform for the products offered in the online store.

Dropsneak is generally not in the direct physical possession of the goods. Products are stored, processed, packed, and shipped by external suppliers, manufacturers, warehouses, or fulfillment partners.

By placing an order, the customer acknowledges that the logistical handling and shipping of the products are carried out by independent third-party partners.

Dropsneak is responsible for customer service and order mediation but not for the physical storage or direct handling of the goods.
